Charco Storage submits waiver, asks town council to reconsider zoning application

Charco Properties has asked the town to reconsider its proposal for a self-storage facility at Flower Mound Road and Old Orchard Lane after it narrowly failed to pass at a town council meeting last week.

The developer sent a letter to town staff and members of town council on Wednesday night and submitted a waiver request for a mandatory waiting period before applying again.

Charco Storage was the subject of much debate at last week’s four-hour meeting. Several people spoke in favor of the project, which is next to Orchard Flower, a 55-and-older neighborhood. There were some homeowners directly adjacent to the property that were opposed to the self-storage facility and were worried about noise and traffic.

The planning and zoning commission voted to deny the project, so it needed to pass town council by a super majority, or four out of five votes. Deputy mayor pro tem Adam Schiestel and council member Janvier Warner voted no.

Normally, an applicant must wait one year before submitting another application for a zoning proposal that was denied. Charco Properties has submitted a waiver that will be considered by the planning and zoning commission.

Another way Charco Storage could go forward is if a member of town council who voted against the project agrees to hear the zoning application again. Schiestel, who was firm in his opposition at the meeting, said he is not willing to bring it back for reconsideration.

O’Neal Gray, the developer, wrote to town staff in his letter that he took the comments from the meeting seriously and is willing to reduce the setback variance by pulling back the upper floors by 20 feet. He also said he has continued conversations with residents that would be impacted.

“My father and I are deeply grateful for the care this community takes in shaping its future, and we are committed to be part of that in the way,” Gray wrote.

If the planning and zoning commission agrees to the waiver, a new application will go through the normal process with the town and could take months. If a council member agrees to rehear the application, the reconsideration would be placed on the next council agenda for the entire town council to vote on. If they approve the reconsideration, the application would be put on the next available council agenda.
